Supreme Court decides Interim Injunction order against Rajapaksa, Cabinet will stay [UPDATE]

(UTV|COLOMBO) – UPDATE: The Supreme Court Friday (14) decided that the Interim Injunction order issued by the Court of Appeal challenging the authority of Mahinda Rajapaksa holding the Office of Prime Minister and his Cabinet, will stand.

However, the Appeal was also granted special leave to proceed. The proceedings of the Appeal Court with regard to the case were stayed until the Supreme Court hearing is concluded.

(UTV|COLOMBO) – UPDATE: The three Judge-benched Supreme Court commenced the hearing after they refused to entertain a five Judge Bench on hearing of the petition against the Interim Injunction order issued by the Court of Appeal challenging the authority of Mahinda Rajapaksa holding the Office of Prime Minister and his Cabinet.

(UTV|COLOMBO) – UPDATE: Hearing on petition against the Interim Injunction order issued by the Court of Appeal challenging the authority of Mahinda Rajapaksa holding the Office of Prime Minister and his Cabinet, commenced before the Supreme Court Judge Bench of Buwaneka Aluwihare, Eva Wansundera, and Vijith K. Malalgoda.

Before the proceedings of Rajapaksa’s petition were initiated Justice Aluwihare pronouncing the retirement of Justice Ewa Wansundera said that today was her last day as a presiding Supreme Court Justice.

He and the Bar also wished and appreciated her service in the judiciary.

(UTV|COLOMBO) – The Supreme Court is scheduled to hear the petition filed against the Interim Injunction order issued by the Court of Appeal challenging the authority of Mahinda Rajapaksa holding the Office of Prime Minister and his Cabinet.

The first hearing of the petition took place on 03 December where an Interim Injunction order temporarily suspending the functions of the Prime Minister, Cabinet of Ministers, Deputy Ministers, and State Ministers, was issued.

During the second hearing of the petition on 12 December, the Appeals Court announced that the Quo Warranto Writ Petition filed by 122 Parliamentarians, challenging the authority of Rajapaksa and his Cabinet will be taken up for hearing once again before Court on 16, 17, and 18 January 2019.

The Court further noted that the Interim Injunction order will remain in effect until a judgment is issued on the petition.

Meanwhile a motion was tabled at the Supreme Court, calling for the petition to be heard before a five-member Judge Bench.
